Terms of Service

These Terms of Service (“Terms”) govern access to www.aniecosmetics.com and related online services operated by PALOMA CASTILLO LLC, doing business as ANIÉ (“ANIÉ,” “we,” “us,” or “our”), including purchases made through the website (collectively, the “Services”). PALOMA CASTILLO LLC is the seller for purchases made through the website.

By accessing or using the Services after receiving notice of these Terms, you agree to them to the extent permitted by law. When you place an order after being shown or given a link to these Terms, you agree that the order is governed by them. If you do not agree, do not use the Services or place an order. Certain provisions apply only when you make a purchase or use the relevant feature.

1. Eligibility

The Services are intended for a general audience and are not directed to children under 13. To place an order, create an account, or enter into a binding transaction, you must be at least the age of legal majority where you live and legally capable of entering a contract. A parent or legal guardian must place an order on behalf of a minor where permitted by law.

2. Privacy and additional policies

Our Privacy Policy explains how we handle personal information. Our Shipping Policy and Returns & Refunds Policy apply to orders and are incorporated into these Terms. Product-specific directions, warnings, and conditions displayed before purchase also apply.

3. Product information and cosmetic use

We try to describe and display products accurately. Screen settings, photography, production variations, and packaging updates may cause reasonable differences in color or appearance. Always review the size, ingredient list, directions, and warnings supplied with the product before use. If product labeling and current website information appear materially inconsistent, do not use the product until you contact us for clarification. We will not make a material substitution without disclosure where disclosure is required.

ANIÉ products are cosmetics unless expressly identified otherwise. They are not intended to diagnose, treat, cure, or prevent disease. Read the complete ingredient list, directions, and warnings before use. Do not use a product if you know you are sensitive or allergic to an ingredient. Stop use if irritation or another unexpected reaction occurs, seek medical advice when appropriate, and report the issue to us using the contact information in the Returns & Refunds Policy. Information on the Services is general product information and is not medical advice.

4. Orders and acceptance

Your order is an offer to purchase. An automated acknowledgment means we received the order; it does not necessarily mean we accepted it. We may accept an order by sending a shipment confirmation or otherwise expressly confirming acceptance.

Before acceptance, we may decline or cancel an order because an item is unavailable; payment fails; we reasonably suspect fraud or unauthorized resale; a purchase limit or shipping restriction applies; the order would violate law; or a material pricing or product-information error occurred. If we cancel an order after payment is authorized or collected, we will release the authorization or issue a prompt refund to the original payment method. We may limit quantities offered to a person, household, account, payment method, or address when reasonably necessary to prevent fraud, unauthorized resale, or inventory abuse.

5. Prices, taxes, and payment

Prices are shown in the currency identified at checkout and may change prospectively without notice. The price displayed at checkout when you submit an order applies, subject to correction of an obvious error before acceptance. Applicable tax, shipping, and other charges will be displayed before you place the order.

You represent that the payment and billing information you provide is accurate and that you are authorized to use the payment method. Payment providers may apply their own terms and privacy notices.

6. Promotions and gift cards

Promotions, discount codes, gifts with purchase, contests, and gift cards may have additional terms disclosed with the offer. Official rules govern a contest or sweepstakes. Unless an offer states otherwise, promotions cannot be combined, have no cash value, and apply only during the stated period. We may modify or withdraw an offer prospectively, but a change will not affect an order already accepted. Gift cards are subject to applicable law and the terms disclosed at purchase.

7. Shipping, returns, refunds, and cancellations

Shipping estimates, delivery, returns, refunds, and cancellation requests are governed by our Shipping Policy and Returns & Refunds Policy. Nothing in these policies or Terms limits rights that cannot lawfully be limited.

8. Accounts

If accounts are available, you must provide accurate information and keep it current. You are responsible for safeguarding credentials and for activity under your account to the extent permitted by law. Notify us promptly at hello@aniecosmetics.com if you suspect unauthorized use. We may suspend or close an account when reasonably necessary to protect the Services, investigate misuse, comply with law, or enforce these Terms.

9. Reviews and other submissions

If you submit a review, photograph, or other content through a feature intended for public posting (“User Content”), you retain ownership of your content. You grant ANIÉ a non-exclusive, worldwide, royalty-free license to host, reproduce, format, and display that User Content in connection with operating, improving, and promoting ANIÉ and the Services, subject to applicable law and our Privacy Policy. This license does not apply to private customer-service messages, safety reports, or privacy requests. If we delete the content from our Services, we will stop making new uses of it within a reasonable period. The license may continue for materials created before deletion and copies retained for legal, security, or recordkeeping purposes.

You represent that you have the rights needed to submit the User Content and that it is honest, accurate to your experience, and does not infringe another person’s rights or violate law. We may moderate or remove User Content for legitimate reasons, but nothing in these Terms prohibits an honest review or lawful report to a regulator or law-enforcement agency.

Do not send confidential business proposals or proprietary ideas. We are not obligated to treat unsolicited ideas as confidential.

10. Intellectual property

The Services—including text, graphics, photographs, product names, logos, designs, software, and their arrangement—are owned by ANIÉ or its licensors and are protected by intellectual-property laws. Subject to these Terms, ANIÉ grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial shopping and informational purposes.

No ANIÉ trademark, logo, photograph, product image, or other content may be copied, modified, distributed, sold, scraped, or commercially exploited without prior written permission, except as law expressly permits.

11. Acceptable use

You may not:

use the Services for unlawful, fraudulent, or abusive activity;
interfere with security, operation, or another person’s use of the Services;
introduce malware or attempt unauthorized access;
use automated means to scrape, harvest, or extract data except as permitted by law or our written consent;
impersonate another person or misrepresent affiliation;
infringe intellectual-property, privacy, publicity, or other rights; or
use the Services or content to create or market a confusingly similar service or counterfeit product.

We may restrict access when reasonably necessary to investigate or stop prohibited conduct.

12. Third-party services and links

The Services may link to or rely on third-party services. ANIÉ does not control those services and is not responsible for their separate content, availability, or privacy practices. A link does not necessarily imply endorsement. Your use of a third-party service is governed by that party’s terms.

13. Service availability and disclaimers

We work to keep the website and online features accurate and available, but interruptions and errors can occur. To the fullest extent permitted by law, we do not promise that the website will always be uninterrupted, secure, or error-free.

This service-availability disclaimer does not disclaim a warranty that applies to a product, a statutory guarantee, or another right that cannot lawfully be excluded. It also does not excuse ANIÉ from fulfilling accepted orders or providing remedies required by law.

14. Limitation of liability

To the fullest extent permitted by law, ANIÉ and its members, managers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Services, even if advised that such damages were possible.

To the fullest extent permitted by law, ANIÉ’s aggregate liability arising from the Services or an order will not exceed the greater of (a) the amount you paid to ANIÉ for the product or transaction giving rise to the claim or (b) US $100.

These limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury, violation of law, product liability that cannot be limited, or any other liability that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions or limitations, so they may not apply to you.

15. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Nothing in this section deprives a consumer of mandatory protections provided by the law of the consumer’s place of residence or limits the right to bring an eligible claim in small-claims court or another court with lawful jurisdiction.

Before filing a claim, we encourage you to contact hello@aniecosmetics.com so we can try to resolve the issue informally. Informal contact is optional and does not shorten a legal limitation period or prevent either party from seeking urgent relief.

16. Changes to the Services or these Terms

We may modify the Services and update these Terms prospectively. The updated Terms will be posted with a revised effective date. We will provide additional notice when required by law. Changes do not retroactively alter the terms governing an order already accepted unless you agree or law permits.

17. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access when reasonably necessary to protect the Services or users, comply with law, or address a material or repeated violation of these Terms. Provisions that by their nature should survive will survive, including provisions concerning ownership, disclaimers, liability, and disputes.

18. General terms

If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent; ANIÉ may transfer these Terms in connection with a merger, reorganization, sale of assets, or operation of the business, subject to applicable law.

These Terms and the incorporated policies form the entire agreement concerning the Services, except for product-specific or promotional terms presented at purchase. If terms conflict, mandatory law controls first; product labeling controls for ingredients, directions, and safety warnings; transaction-specific terms presented and accepted at checkout control that transaction; the Shipping Policy or Returns & Refunds Policy controls its specific subject; and these Terms control other matters.
